Welcome to Gaimnite. Please read these Terms of Use ("Terms") carefully before using our website, platform, and services (collectively, the "Service"), operated by Gaimnite ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

2. Accounts

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate.

You are responsible for maintaining the confidentiality of your password and account. You accept responsibility for all activities that occur under your account. Notify us immediately of any unauthorized use or suspected breach.

The Service and all content, functionality, and features (excluding user-generated content) are and will remain the exclusive property of Gaimnite and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws in the United States and abroad.

By uploading or submitting content (e.g., sketches or other materials), you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, and distribute such content only as necessary to operate, improve, promote, and provide the Service.

You retain all rights to your content. We do not claim ownership over it.

5. Purchases and Tokens

You may purchase digital credits or tokens to use within the Service. Payments are securely processed by Stripe, and you agree to Stripe's terms of service when using their platform.

All purchases are final. Tokens are non-refundable and non-transferable, except as required by law.

6. Termination

We may terminate or suspend your access to the Service at our sole discretion, without notice or liability, for any reason, including if you violate these Terms.

Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted or error-free or that content will be accurate or reliable.

8. Limitation of Liability

To the maximum extent permitted by law, Gaimnite and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, profits, or goodwill, arising from your use or inability to use the Service.

In no event shall our total liability for all claims exceed $100 or the total amount you paid us in the past six months, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Gaimnite and its affiliates, officers, agents, and employees from any claims, damages, obligations, losses, liabilities, costs, or debt resulting from your use of the Service or your violation of these Terms.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising out of these Terms or use of the Service shall be resolved by binding arbitration in San Francisco County, California, except that either party may seek equitable relief in court for alleged infringement of intellectual property or unauthorized use of confidential information.

You waive any right to a jury trial or to participate in class actions.

11. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you at least 30 days in advance through the Service or via email.

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
